Placing it on the ‘no’ suggests you’ve been asked to do a count, and found none.
Placing it on ‘are’ fits the actual situation – a claim has been made, fact checked, and found to be counterfactual.

Isn’t SEMME claimed to be a secret organisation? I.e. SEMME legally doesn’t exist?
Cause and effect is the other way – ‘Jason doesn’t legally exist’ is what they found, not a consequence of their checking his background.
